In 2023, the government initiated two consultations on holiday rights. This action was partly in response to the 2022 Supreme Court decision in Harpur Trust v Brazel and also aligned with the post-Brexit reforms outlined in the Retained EU Law (Revocation and Reform) Act 2023 (REUL Act).

The government has recently updated its guidance, clarifying previously unanswered questions, such as the definition of a part-year worker. The below guides set out the main proposed changes and how annual leave entitlement and pay should be calculated.

The Regulations have been approved by Parliament and came into force from 1 January 2024.
